HARYANA INFORMATION COMMISSIONER DIRECTS SPIO’S TO PRODUCE RECORDS WITHIN AN HOUR, GRANT COMPENSATION TO APPELLANT, ASKS TO PROVIDE INFORMATION.

Have you seen movie “Nayak” of Amrish Puri and Anil Kapoor in key roles? That scene was enacted at the State Information Commission, Haryana, Chandigarh on 9.1.2015. Hon’ble State Information Commissioner directed the three officers/SPIOs of DT&CP at around 1.30 p.m. to bring record of diary and dispatch within an hour and called them again at 2.40 p.m. to resume the hearing the second appeal filed by of M K Gupta. (Self).

SIC also told to reply to my query "Whether the company has ever been blacklisted or any of its licence has been suspended/revoked/terminated during 1.1.2008 till date." The query relates to Vatika Ltd.

During the hearing of RTI application dated 10th June, 14, three SPIOs/officials of Deptt. of Town and Country Planning, Haryana, Chandigarh were present and the concerned SPIO stated that he has received the RTI application on 20/21 August, 2014 along with the order of the First Appellate Authority. In his order, FAA directing the SPIOs to supply information and advised them to be careful in future. When the SPIO’s returned with a two pages print-out, it was revealed that the Department is not maintaining the dispatch and diary registers and this record is maintained only on computers. This made the Information Commissioner to comment that such practice had made mockery of RTI Act, may allows doctoring of records and therefore the department should also maintain such records in dispatch and diary registers too to prevent this. He also told the SPIOs to give information, “Whether the company has ever been blacklisted or any of its licence has been suspended/revoked/terminated during 1.1.2008 till date.

On another RTI application dated of 6th June, 2014, the Information Commissioner Shri Jasbir Singh Kundu, Major General, (Retd), AVSM directed the Deptt. of Town & Country Planning, Chandigarh to conduct an inquiry about the exact date of receipt of my RTI application and submit its finding to him. I presented the documentary proof from the “Dak Pustak” (Peon Book) of DTP, NCR, Panchkula that the RTI application was in fact delivered on 16.6.14 while the SPIO maintained that the same was delivered to him on 20/21st August, 14 along with the order of the First Appellate Authority.

The Information Commissioner also asked to provide information about the action/penalty which can be imposed on the licencee (i.e. Planet Earth Estate Pvt. Ltd.) and Vatika Ltd. for selling the flats without any authorization. He also told to inform about the action which can be taken for uploading and promoting that project by concealing the important facts about licence on the website of Vatika Ltd. to appear that project as its own to mislead the potential buyers.

J.S. Kundu, Information Commissioner also told the Department to give compensation of Rs. 1,500/- to the appellant. (Note-copy of decision is awaited).
