WHY ECONOMIC CRIMES ARE MORE HEINOUS IN NATURE THAN OTHER CRIMES

 – AS SUCH CRIMES AFFECT THE VICTIMS, SOCIETY AT LARGE & THE NATION.

Heinous means shocking, evil, monstrous, grave, awful, vicious, outrageous, revolting, infamous, hideous, unspeakable, atrocious, flagrant, odious, hateful, abhorrent, abominable, villainous, nefarious, iniquitous, execrable.

Crimes that are likely to leave the victim/family emotionally scarred. Examples would be murder, robbery, kidnapping, rape, extortion, financial frauds, attempted murder, and grievous bodily harm. They tend to be the types of crimes that make people cringe at the mention of.

These are crimes that are revolting to the average person. They are malum per se.

WHEREAS, all such crimes which are heinous for being grievous, odious and hateful and which, by reason of their inherent or manifest wickedness, viciousness, atrocity and perversity are repugnant and outrageous to the common standards and norms of decency and morality in a just, civilized and ordered society should be punishable by death;

WHEREAS, due to the alarming upsurge of such crimes which has resulted not only in the loss of human lives and wanton destruction of property but also affected the nation's efforts towards sustainable economic development and prosperity while at the same time has undermined the people's faith in the Government and the latter's ability to maintain peace and order in the country;

WHEREAS, in the interest of justice, public order and the rule of law, and the need to rationaliSe and harmoniSe the penal sanctions for heinous crimes, there are compelling reasons to impose the death penalty for said crimes :-

WHEN EVER a crime is accompanied by murder, homicide, physical injuries or rape.

WHEN EVER any Public Servant who, by himself or in connivance with members of his family, relatives by affinity or consanguinity, business associates, subordinates or other persons, amasses, accumulates or acquires ill-gotten wealth through a combination or series of overt criminal acts should be guilty of the crime of plunder and shall be punished by reclusion perpetual to death. Any person who participated with the said Public Servant in the commission of an offence contributing to the crime of plunder should likewise be punished for such offence. In the imposition of penalties, the degree of participation and the attendance of mitigating and extenuating circumstances should be considered by the Courts. The Courts should declare any and all ill-gotten wealth and their interests and other incomes and assets including the properties and shares of stocks derived from the deposit or investment thereof forfeited in favour of the State.

No doubt murder, homicide, physical injuries or rape are heinous crimes but the fact remains that usually one victim is the sufferer and/or at the most a couple of his dependents suffer the loss.

WHEREAS WHITE COLLAR CRIMES especially financial frauds, property frauds, investment frauds, quick rich scheme frauds, banking frauds, insurance scheme frauds, frauds by builders/land estate agencies and all such frauds as a result of which the innocent common people die many a death as a result of the misery thrust upon them by perpetrators of such frauds till they physically die and their dependents suffer the same and continue to suffer the same till they physically die. The number of victims of white collar crimes at times runs into thousands & as such white collar crimes are turning to be more heinous than all other heinous crimes put together and should be treated accordingly and the perpetrators of white collar crimes should be held guilty of the crime of looting & plunder and should be punished by reclusion perpetual to death.

It Is Heinously Unfortunate To Note That When Ever “A Victim And/Or Victims Of White Collar Crimes” Approaches The Police The Oft Repeated Statement Of Practically Every Police Officer Is & We Quote “Koi Murder To Nain Huan Hai – Yeh White Collar Crime Hain Aur Hum White Collar Crime Ko Heinous Nahin Maante”.

THIS THINKING WILL HAVE TO CHANGE BECAUSE AS A RESULT OF THIS THINKING & CALLOUS ATTITUDE OF THE POLICE OFFICERS WHITE COLLAR CRIMES ARE RAPIDLY ON THE INCREASE & THE TRAVESTY IS THAT PERPETRATORS OF WHITE COLLAR CRIMES GET AWAY WITH IT AND RARELY GO PUNISHED. THE AGNOSTIC SITUATION OF THE UNFORTUNATE VICTIMS IS THAT THEY NEVER GET THEIR HARD EARNED MONEY BACK.
