MCD REFUSES TO GIVE NAMES OF EMPLOYEES DEFAULTED IN SUBMITTING ANNUAL PROPERTY RETURNS.

Either the PIO, MCD is unable to understand English and considers the RTI applicants fools. If we ask about ‘A’ and MCD is reluctant to tell about that, it will talk about ‘B’. This has been experienced by Rejimon CK of Dwarka. Rejimon who is also President of the Dwarka Forum asked the MCD (South Zone) to provide the names of staff who have not submitted annual statement of their asset as required under the Conduct Rules. He also requested that if no list of such employees has been prepared, in that case to provide the reasons recorded for not preparing the same.

To this, M K Bhardwaj, PIO, MCD informed that such information from its employees has been provided to the Deptt. under the fiduciary relationship and is therefore exempt u.s.8(1)(e) of the RTI Act. He has also cited some irrelevant decisions and also has taken the plea that providing information will disproportionately divert the resources of the Department.

Applicant has not asked copies of the returns submitted by the employees but demanded list of employees who have not submitted their return. The MCD has converted it that the applicant has asked the copies of their immovable property returns. For this innovation, the PIO really deserves appreciation from the defaulting employees.
